Terms of Use Agreement

1. Introduction -

This Terms of Use Agreement, the Privacy Policy, the terms and provisions, and all policies published by the Beamaan platform have been established to protect and preserve the rights of both (the Beamaan platform) and (the user who accesses the site, whether registered or not) or (the client benefiting from advertisements, whether registered or not). These terms, conditions, provisions, and legal disputes are governed by the laws, legislation, and regulations in force in the Kingdom of Saudi Arabia. As a user, you agree to be bound by everything stated in this Agreement when using the site, accessing it, or registering for the service. Beamaan reserves the right to amend this Agreement at any time, and such amendments become binding on all parties once the update is announced on the site or through any other means.

2. Definitions

  • Account

    means the account created by the user through the platform to use the services;
  • Agreement

    refers to this Agreement, the current operating rules contained on the site, and the transaction escrow instructions.
  • Transaction

    consists of terms set by the seller or buyer containing the details of the product to be sold and other details such as the seller's or buyer's number, which are agreed upon by both parties before becoming enforceable
  • Transaction Detail Screens

    means the screens found on the site where users provide all required information relating to the transaction.
  • User

    collectively means the person or entity that has visited or uses the platform and/or the services. A user may be a seller, a buyer, both, or neither

3. Services

  • Beamaan is a platform for managing commercial operations that enables users to buy and sell online safely
  • All transactions on or through the platform are denominated in Saudi Riyals
  • Create a new transaction
  • Review the transaction details
  • Accept or reject the transaction if it does not suit you
  • Pay for the transaction using your preferred payment method
  • Transfer the seller's proceeds from the Beamaan platform account to their personal account

4. Limits of Services

The services are available only for legal items and provisions that have not been excluded under Section 5 below. Restrictions may apply to the services and can be found on the site or in the general escrow instructions or transaction escrow instructions. Only registered users may use the services. To register, you must provide all information required on the site. Applicable government or federal laws and regulations may further restrict the services.

5. Prohibited Transactions

Users may not use the site or the services in connection with any transaction that is illegal, involves any illegal elements, or is for any illegal purpose; includes any obscene material; includes any ammunition or firearm; includes pirated software, DVDs, videos, or item(s) that infringe copyrighted works; includes illegal drugs or controlled substances; involves real estate or any interest in real property, or the sale or transfer of liquor licenses, the sale of tobacco or smoking products, the sale of a business (bulk sale), the transfer of ownership to a business entity, an escrow fund or joint escrow, mobile or manufactured homes, or the refinancing of any type of security deposit, promissory notes, mortgages, or deeds of trust; or transactions that directly or indirectly involve persons (individuals or entities) sanctioned. In addition, Beamaan may, at its sole discretion, refuse to complete any transaction it has reason to believe is unauthorized or was made by someone other than you, may violate any law, rule, or regulation, or if Beamaan has reasonable grounds not to honor it. Each user agrees to indemnify and hold Beamaan harmless from losses resulting from any use or attempted use of the services in violation of this Agreement.

6. Payment Rejection

Because the use of a bank account, credit card account, debit card, or electronic funds transfer may be restricted by your agreement with your financial institution and/or applicable law, Beamaan is not liable to any user if Beamaan does not complete a transaction as a result of any such restriction, or if a financial institution fails to honor any credit or debit to or from the account. Beamaan may publish operating rules relating to payment on the site and change these rules from time to time.

7. General Terms of Use

If you access the site through entities affiliated with and/or integrated with Beamaan, or otherwise through or via a third party (for example, an auction, exchange, or online intermediary that hosts electronic marketplaces and mediates transactions between businesses), then you authorize that third party to transfer relevant data to Beamaan to facilitate the transaction. You acknowledge and warrant that all information you provide to Beamaan or to such third party will be true, accurate, and complete. The party entering into this Agreement on behalf of any user warrants that they are authorized to do so, that it binds the user, and that they are a natural person at least eighteen (18) years of age. In order to initiate and begin a transaction, all users in the transaction must register on the site, agree to all terms contained in the general escrow instructions, and agree to the transaction escrow instructions.

8. Sellers' Obligations

On the transaction detail screens, each seller in a transaction must designate an account to which payment for the transaction is made. Each seller authorizes authorized parties to initiate credit entries to that seller account for payment of the purchase price, or the applicable outstanding balance, and to debit the seller account to fulfill the seller's obligations. Each seller in a transaction must deliver the items specified in the transaction detail screens directly to the buyer (or buyers), at the address specified by that buyer as shown on the Beamaan site, and in accordance with the terms and conditions set out in the transaction escrow instructions and the general escrow instructions. The seller must use a delivery service that provides confirmation of delivery, and the seller must provide Beamaan with a tracking number or reference for the shipment of the goods. The seller grants Beamaan permission to act as its agent in communicating with the shipping company regarding notice of delivery of the goods. If Beamaan does not receive shipping notice from the seller within ten (10) calendar days of Beamaan notifying the seller to ship the items, the seller authorizes Beamaan to return the escrowed funds (excluding Beamaan's fees) to the buyer. If the buyer returns the items, the seller must notify Beamaan of receipt of the returned items. Upon receiving this notice from the seller, a seller inspection period of 1–30 days begins. If the seller accepts the returned items during the inspection period, or takes no action during the inspection period, Beamaan must transfer the escrowed funds (excluding Beamaan's fees) to the buyer. If the seller notifies Beamaan that they do not accept any returned goods during the seller's inspection period, Beamaan will hold the escrow funds until the dispute is resolved or other action is taken as authorized. Notwithstanding anything to the contrary above, if all users in a transaction agree on the transaction detail screens that no shipping is required, then no party under this Agreement shall be bound by any obligation under this Agreement relating to shipping.

9. Buyers' Obligations

On the transaction detail screens, the buyer must designate a payment mechanism and account through which the purchase price and related fees (unless the seller pays these fees) are obtained for deposit into escrow. Depending on the transaction amount and the currency specified for the transaction, the buyer may transfer the necessary funds through various methods, which may include a corporate credit card, debit card, purchase card, check, cashier's check, money order, ACH debit, or wire transfer. In the case of wire transfers, the buyer will initiate the wire transfer to an account designated by Beamaan on or before the date specified on the transaction detail screens. Regardless of the payment method, the buyer authorizes Beamaan and Beamaan's authorized agents to initiate credit or debit transactions, as applicable, to obtain the purchase price and fees due for the transaction, and to initiate any credit entries or withdrawals, as the case may be, to correct any payment or transfer error and to fulfill the buyer's obligations. Beamaan will deposit funds received from the buyer into an escrow credit account maintained by Beamaan (the "Escrow Account"), unless otherwise required as specified in the following sentence. The buyer must notify Beamaan of receipt or non-receipt of the items on the date the goods are received, or initiate the buyer's inspection period. The buyer must notify Beamaan of their acceptance or rejection of the goods before the end of the buyer's inspection period. Upon receiving notice from the buyer that the items have been received and accepted, Beamaan must transfer the payment amount (less any amount owed to Beamaan for Beamaan's fees) to the seller's account. The transfer to the seller will generally begin within the next business day from the day the buyer's acceptance notice is received. If the buyer does not notify Beamaan of non-receipt or rejection of the items during the buyer's inspection period, the buyer then authorizes Beamaan to transfer the deposited funds (excluding Beamaan's fees) to the seller. The buyer must follow the procedures set out on the site in the event of rejecting the items.

10. Transaction Cancellation

If a transaction cannot be completed for any reason, including cancellation by Beamaan for any reason, Beamaan will notify each user in that transaction by email or phone, to the email address or phone number provided by each user to Beamaan. At Beamaan's sole discretion, Beamaan may cancel any transaction if any user in the transaction fails to agree to the terms as required on the transaction detail screens by clicking the "Agree" button as required on the site.

11. Data and Verification

You agree that all disclosures and communications relating to this Agreement and the Service must be made by email, phone number, or on the site, unless the parties make other arrangements as provided in the general escrow instructions.

12. Fees

Unless otherwise agreed by each user in the transaction, the buyer agrees to pay the service fees disclosed on the site at the time the completed transaction escrow instructions are agreed to by all such users, in addition to any other fees, including, but not limited to, third-party service fees (for example, shipping, appraisal, inspection, etc.). Once paid, Beamaan's fees are non-refundable. Beamaan's fees may change from time to time at Beamaan's sole and absolute discretion. Beamaan is not responsible for paying any sales, use, personal property, or other government taxes, or any tax imposed on any goods purchased or sold through the services or arising from the transaction.

14. Disclaimer

You expressly agree that your use of the services is at your sole risk. The services are provided strictly on an "as is" and "as available" basis. Beamaan makes no warranty regarding the underlying transaction, any items you obtain through use of the site or the services, that the services will meet your requirements, or that the services or the site will be uninterrupted, timely, secure, or error-free.

15. Privacy Policy

Privacy and confidentiality statement — we appreciate your concerns regarding the privacy of your data on the internet. This policy has been prepared to help you understand the nature of the data we collect from you when you visit our website and how we handle this personal data.

  • IP address: whenever you visit any website, including this one, the hosting server will log your Internet Protocol (IP) address, the date and time of the visit, the type of browser you use, and the URL of any website that referred you to this site.
  • Links to other websites: our site may include links to other websites. We are not responsible for those sites; you can review the privacy policies and content of those sites accessed through any link within this site.
  • Disclosure of information: we will at all times maintain the privacy and confidentiality of all personal data we obtain. This information will not be disclosed unless required by law, or when we believe in good faith that such action is required or desirable to comply with the law, or to defend or protect the proprietary rights of this site or the entities benefiting from it.
  • Data necessary to carry out transactions requested by you: when we need any data of yours, we will ask you to provide it voluntarily. This information will help us contact you and fulfill your requests wherever possible. Data you provide will never be sold to any third party for the purpose of marketing it for their own benefit without obtaining your prior written consent, unless it is done on the basis that it is part of aggregate data used for statistical and research purposes without including any data that could be used to identify you.

Amendments to the confidentiality and privacy policy: we reserve the right to amend the terms and conditions of the confidentiality and privacy policy if necessary and whenever appropriate. Amendments will be implemented here or on the main privacy policy page, and you will be continuously informed of the data we have obtained, how we will use it, and the parties to whom we will provide this data.
